   सत्र न्यायाधीशों द्वारा सिद्धदोष सभी व्यक्तियों को उच्च न्यायालय के समक्ष अपील करने का अधिकार है .

   फौजदारी मामलों में अपील उच्चतम न्यायालय में हो सकेगी , यदि ( क ) उच्च न्यायालय ने किसी अभियुक्त की दोषमुक्ति के आदेश को उलट दिया है और उसको मृत्युदंड का आदेश दे दिया है , या ( ख ) अपने अधिकार के अधीन किसी न्यायालय से किसी मामले को विचारण के लिए अपने पास मंगा लिया है और ऐसे विचारण में अभियुक्त को सिद्धदोष ठहराया है और उसे मृत्युदंड का आदेश दे दिया है ( अनुच्छेद 134 ; रामकुमार बनाम मध्य प्रदेश राज्य , ए आई आर 1975 एस सी 1026 ; पड्डा नारायण बनाम उत्तर प्रदेश राज्य , ए आई आर 1975 एस सी 1252 ) .
