Although, a request can be made in the Parliament for the required funds.The Parliament if authorizes the fund can be withdrawn provided the equivalant amount withdrawn from the emergency fund is compensated by transfer of funds from the collective public fund. The AAct 267 also authorizes the states to set up it respective emergency funds.
   - अनु 267 संसद को निधि जो कि आपातकाल मे प्रयोग की जा सकती हो स्थापित करने का अधिकार देता है यह निधि राष्ट्रपति के अधीन है इससे खर्च धन राष्ट्रपति की स्वीकृति से होता है परंतु संसद के समक्ष इसकी स्वीकृति ली जाती है यदि संसद स्वीकृति दे देती है तो व्यय धन के बराबर धन भारत की संचित निधि से निकाल कर इसमे डाल दिया जाता है अनु 267 राज्यॉ को अपनी अपनी आपातकाल निधि स्थापित करने का अधिकार भी देता है
