1. Judicial Review : Judicial review as it has evolved in the United States means the power of the highest court of the land to finally pronounce upon the legality or otherwise of a legislative act in so far as it conforms , or does nor conform , to the provisions of the fundamental law , i.e . the Constitution of the land .
   न्यायिक पुनर्विलोकन 1 : न्यायिक पुनर्विलोकन का विकास जिस रूप में अमरीका में हुआ है , उसके अंतर्गत देश के सर्वोच्च न्यायालय को अधिकार है कि वह इस बारे में विधायी कार्य की वैधता या अवैधता के संबंध में अंतिम निर्णय सुना सकता है कि वह कहां तक मूल विधि यानी देश के संविधान के उपबंधों के अनुरूप है या नहीं है .
2. Judicial Review and Appeal Revision Under the above mentioned Acts , any person subject to the said Act and who is governed by any order passed by any Court Martial , can present a petition to the officer or authority empowered to confirm any finding or sentence of such Court Martial and the confirming authority can take such steps as may be considered necessary to satisfy itself about the correctness , legality or propriety of the order passed or the regularity of any proceeding to which the order relates and the punishment is awarded .
   न्यायिक समीक्षा और अपील पुनरीक्षण उपर्युक़्त अधिनियमों के अधीन , किसी अधिनियम के अध्यधीन कोई व्यक्ति जो किसी सेना न्यायालय द्वारा पारित किसी आदेश द्वारा शासित है , उस सेना न्यायालय के निष्कर्ष या उसके द्वारा दिए गए दंड की पुष्टि करने की शक्ति से संपन्न अधिकारी या प्राधिकारी को याचिका प्रस्तुत कर सकता है और पुष्टिकर्ता प्राधिकारी सेना न्यायालय द्वारा पारित आदेश की यथार्थता , वैधता अथवा उपयुक़्तता या उस आदेश से संबंधित किसी कार्रवाई और दिए गए दंड की नियमितता के विषय में स्वयं को संतुष्ट करने के लिए जो भी कदम उठाना आवश्यक समझे , उठा सकता

4. Such power implies that, when West fights non-West, the outcome on the battlefield is a given. That settled in advance, the fighting is seen more like a police raid than traditional warfare. As in a police raid, modern wars are judged by their legality, the duration of hostilities, the proportionality of force, the severity of casualties, and the extent of economic and environmental damage.    परंतु इस प्रकार प्रत्येक पक्ष द्वारा अपनी पीड़ा और क्षति को उजागर करने की प्रवृत्ति उस ऐतिहासिक क्रम को परे हटाती है जहां प्रत्येक पक्ष स्वयं को अधिक क्रूर , कठोर और विजयी के रुप में प्रदर्शित कर शत्रु को भयभीत करता था . उदाहरण के लिए द्वितीय विश्व युद्ध में अमेरिका के युद्ध सूचना विभाग ने युद्ध के प्रथम दो वर्षों में मृत अमेरिकी सैनिकों के चित्र या फिल्म दिखाने को प्रतिबंधित कर दिया गया था जिसे बाद में कुछ हद तक हटा लिया गया था .इस बीच सचल चलचित्र ब्यूरो ने “जापानी हमारे शत्रु ” जैसी फिल्मों का निर्माण कर जापानियों के मृत शरीर और जापानियों की अभावग्रस्तता को दिखाया .
